Do I need to get roommate approval for new renter who is replacing me on lease?

I need to exit my lease due to an emergency and an online add responder is willing to take it over for me. My question is, do my current roommates need to approve of my friend before his move in and sign-on to the lease? I really do not want to end on bad terms, but I cannot afford it anymore and I do not know what else to do, as breaking the lease would cause legal complications.

  1. It depends who the lease is signed by etc.

    If it is down to the landlord then you just need to tell them the situation and ask to get it changed.

    If it is done by all your room mates then you need to talk it out with them. If they don’t like the person but they have to sign the paper for them to move it all they have to do is refuse to sign it ar cause issues for you!

    Look at your contract and what it says to leaving or signing your ‘share’ over. Talk to your room mates about the issue and then deal with it from there.

  2. Your lease is a legally binding contract between all parties which signed it. A written contract cannot be modified, altered or changed without the written agreement of all the parties to the contract.

    Your roommates and landlord would have to agree to or approve of the replacement tenant.

    If any of your roommates or the landlord do not agree to or approve of the replacement tenant, then you are stuck.
